WAIVER AND RELEASE OF LIABILITY

As a member of RIB ACADEMY, I understand and agree that this is a special community that can only exist if rules are followed and respect for fellow members and the facility is maintained.

 

In consideration for being allowed to use the facilities, I hereby agree to the following:

Liability about injury:

1. I understand and acknowledge that the use of gym equipment, weights, other exercise devices and recovery equipment can be hazardous and may cause serious injury or even death.

2. I understand and acknowledge that I am responsible for my own safety and well-being while using the gym facilities and equipment.

3. I agree to follow all posted rules and regulations of the gym, including but not limited to using equipment properly, refraining from behaviour that may endanger myself or others and not granting non-members entry.

4. I understand and acknowledge that the gym staff are not responsible for any injuries or accidents that may occur as a result of my use of the facilities and equipment.

5. I hereby release and hold harmless the 24/7 gym, its owners, employees, and agents from any and all liability for any injuries, damages, or losses that may result from my use of the gym facilities and equipment.

Liability about health issues:

1. I understand and acknowledge that there are inherent risks associated with exercise, including but not limited to heart attack, stroke, and other serious medical conditions.

2. I understand and acknowledge that exercise can be physically demanding and may aggravate pre-existing medical conditions. I represent that I am in good physical condition and have no medical condition that would prevent me from using the gym facilities and recovery equipment.

3. I acknowledge that it is my responsibility to monitor my own physical condition and to stop exercising immediately if I experience any pain, discomfort, dizziness, or other symptoms that may indicate a medical problem.

4. I agree to provide the gym with accurate and complete information regarding my health and medical history, and to update the gym immediately if there are any changes to my health status that may impact by ability to exercise safely.

5. I understand and acknowledge that the gym staff are not medical professionals and are not qualified to diagnose or treat any medical conditions.

6. I agree to assume all risk and responsibility for any injuries, damages, or losses that may result from my use of the gym facilities and equipment, including but not limited to aggravation of pre-existing medical conditions.

7. I understand that using the cold plunge or infrared sauna can pose certain risks including but not limited to: Hypothermia Hyperthermia, Shock, Dizziness, Nausea, Fainting, Muscle cramps, Heart complications. I certify that I do not have any medical condition that would prohibit or limit my ability to safely participate in cold plunge or infrared sauna activities. I have consulted with a physician if necessary, and I am in good health and physical condition.

8. I hereby release and hold harmless the 24/7 gym, its owners, employees, and agents from any and all liability for aggravation of pre-existing medical conditions.

Liability about personal possessions:

1. I understand and acknowledge that I am responsible for my own personal possessions while using the gym facilities and equipment.

2. I agree to keep my personal possessions with me at all times, and to not leave them unattended.

3. I understand and acknowledge that the gym is not responsible for any loss, theft, or damage to my personal possessions, including but not limited to wallets, jewellery, electronic devices, and clothing.

4. I agree to assume all risk and responsibility for any loss, theft, or damage to my personal possessions while using the gym facilities and equipment.

5. I hereby release and hold harmless the facility, its owners, employees, and agents from any and all liability for any loss, theft, or damage to my personal possessions while using the gym facilities and equipment.

Liability about CCTV/Media release:

1. I understand that CCTV cameras are installed in designated areas and will continuously monitor and record activities within these areas.

2. Recorded footage will be stored securely and retained for a period not exceeding [30 days], unless required for investigative purposes.

3. The recorded footage will be treated as confidential and will not be shared with unauthorized persons or entities. Footage may be shared with law enforcement agencies if necessary for legal or investigative purposes.

4. You understand that photographs and videos may be taken of you while you are participating in gym activities, classes, or events.

5. These images and videos may be used in a variety of media formats, including but not limited to social media, websites, brochures, newsletters, and other promotional materials.

6. The images and videos will be used solely for the purpose of promoting and marketing the gym and its services.

7. The gym will not sell or distribute your images and videos to third parties for commercial purposes without your consent.

8. You grant the gym the right to use and edit your images and videos as needed for promotional purposes.

9. You acknowledge that you will not receive any compensation for the use of your images and videos.

10. This consent is perpetual, meaning it does not expire unless you choose to revoke it in writing.

 

I understand and acknowledge that this waiver and release of liability is binding upon myself, my heirs, executors, administrators, and assigns.

By signing below, I acknowledge that I have read and understand the terms of this waiver and release of liability and voluntarily agree to its provisions.
